My father was sent to prison for a white collar crime (Florida) in November of 96 for 5 years. In October 96, he gave his attorney $15,000 up front for an appeal.

My father died 5 months later in April 97 in prison of cancer. His attorney would not return the monies to the children as I requested, because he said he would use it to clear his name. Up until that time, he had done nothing on his case. In the meantime, because his name was not cleared, judgement(s) have been put upon the Florida home my father left me. I reside in Hawaii at this time.

It has now been 3 years, and after numerous phone calls and certified letters, the attorney will not take any calls, return any calls, nor respond to me, to let me know what, if anything, has been done to clear his name, what work has been done, or return the money.

Is there anything we can do at this point in time?

Thanks for your any suggestions or help you may have.

My response:

Contact the Florida State Bar. They will send you complaint forms, and you fill them out, telling your story as you've said it here - - of course, with proper names and addresses. They'll investigate and, if your complaints are founded, they will take appropriate action to get your money and take care of that scoundrel.
