Back in August 2004 after a few phone conversations we have placed a deposit on an unborn puppy through PayPal based on the advertisement placed on the breader's website. The contact and health guarantees were signed prior to that. The litter was born on October 8. I would call the breeder every week to check on the puppies. On November 9, I placed a regular phone call to the breeder and was told that my puppy had died the night before (no explanation was provided). At the time, they did not have other puppies available and we really needed a puppy in December so the breeder agreed to return the deposit. Ever since then we have been trying to get our money back without any success. We have a number of e-mails from the breeder apologizing for the delay and with a promise to send a check the following week, but it never happened. Here are some of the excuses that were provided to us: the breeder doesn't handle refunds herself and will have to check with the secretary (who only works part-time) on what happened; they are too busy with the charity work in church during holidays; claim that the check was sent to us, but would not confirm whether it cleared the bank or not after were told that we haven't received it; etc. We tried contacting PayPal, but they would only handle refunds within 30 days from the day of purchase. The American Express (that's what we have linked on PayPal) have 60 days limitation. We did not know what else to do but to fill out an Internet Fraud complaint with the FBI, but that did not go anywhere either. Now the breeder would not even respond to our e-mails. Any suggestions? We are talking about $250.00.
