My ex & I can't agree on custody & visitation. We each want sole custody of our 22 mth old son. Our son lives with me & my parents. He sees his father 2-3 times a week, if he's not complaining of being too tired from work. My ex picks up our son every Sat., he's always late picking him up.
Is there a way we can work it out without upsetting our son & making us both happy?

Fighting over sole custody is a waste of time. It's rarely ever given and when it is, there is a good reason. Joint legal custody is the standard with the primary caretaker have residential custody.

How much visitation is he wanting?

Sole custody?

There is legal and physical custody.

Usually legal is shared, physical goes to the person who was the primary caretaker. However, it is generally primary physical, meaning the other party has visitation. Sole physical custody would not even allow for visitation.

The BEST thing for your child is shared 50/50 physical custody.

As for his being late, dont sweat it, just get used to it, bring something to read and never complain about it, it wont change anything.

Sole custody does allow for visitation to the NCP. What it doesn't allow, is for the ncp to have any legal input for things like schooling, medical care, etc.

50/50 is not always in the best interests of the child.

As far as him being late, she can ask not to have to wait longer than X amount of time, although it needs to be a reasonable amount of time, w/o having made prior arrangements.
