can't get a title!

What is the name of your state? Mississippi

In Oct 2004 we purchased a nissan 240sx from a private party. The car did not run. We have a bill of sale with names, price and date.

The parents sold the car for the son and signed his name on the bill of sale b/c he lives in florida. They however had lost the title and said they would apply for one.

It is now march and no title has been applied for, we call and call and the mom says she doesn't know what has happened. We call the car tags place in Jackson no proof she has ever filed for the title. But the car isn't in her name. The title is in her sons name.

Should we take her to small claims court? Do we have any recourse? We have put an engine in the car and it runs but can't get tags. Can we get what we paid for the car back?

HELP!!!!
 


Stop talking and start writing

Contact these people by certified mail, RRR. Give them a specific date to provide you with a valid, transferrable title. Assigned to you, signed by the registered owner and the signature notarized( if necessary in the title state).

If you do not hear from them within a reasonable length of time, contact the state DMV, speak to their "complaint department" concerning their selling you the vehicle minus a title. Go from there.

I hope your bill of sale made a provision for delivery of the title. I am not familar with Mississippi or Fla laws concerning titles but some states are what they call "title states" and the title is held by the Lien holder (if any) until the lien is satisfied. Are you sure there was no money owed on this car and a bank or finance company does not have the title. DMV should have been able to check the vin to see whose name the car is registered in, any liens,and when it was last tagged unless it's been so long the title has been purged from the system.
