Can't get deposit back

please help, i feel like i've been robbed. i rent an apartment in dallas, tx. i asked my current apt. complex to find a bigger apt. for me. they asked for a deposit and told me that if they didn't find an apartment for me within the complex within 3 mo. they would return my deposit. i agreed (didn't sign anything) and told them upfront that i did not want an apt. on the bottom floor.

they called twice within that period of time offering me two apt.s on the bottom floor. i refused them. after four months i am now asking for my deposit back. they tell me that i can't have it back since they did offer me two apt.s within the time period they promised.

do i have any recourse in getting my deposit back???

I am always incredulous about someone who gives money without getting a clear agreement as to what it was for.

I suggest that you send a letter detailing what you thought that the arrangement was, and why you should have your money refunded. The purpose here is not to intimidate the complex management, but to make your feelings clear and to get a clear response back about how the management sees it. You are better off to get that now, then to go to court and find it out there.

Based on the response, you can make a determination if you have been robbed or not, and why.
