I got hit from behind while stopped. The other driver is at fault. I paid to have my car fixed but the other guy's insurance wont reimburse me for the repair. They are saying that my car was worth less than the repair. Can I do anything? I am I stuck because I paid for it?

Bryan, no you are not stuck. That insurance carrier of the person at fault is legally obligated to pay for the repair. It doesn't matter what state you are in. Anytime an accident occurs, and there is damage to one's vehicle, the person at fault has to get it fixed, or find you a comparible vehicle of the same as you had. Try researching your state's laws in referance to auto collisions. I feel sure you will get restituted/reimbursed.

Geez, I looked for laws...I wonder where they are. My car is repaired. Its worth about 8000 on a lot and the repair was 5500. My brother-in-law owns the shop so I owe him the money. Insurance company says they would buy the car for 6600. Do I have to sell it to them? They are not offering to pay for the repair but only to buy the car.
