Can't prove he wasn't driving car when it crashed

What is the name of your state? New Jersey

Scenario: family member had too much to drink at a party & was sleeping it off when someone in the house took his keys and went for a joyride in his car. He crashed it into a pole, and ran off. No one seems to know anything, and no one is coming forward to take the blame. Meanwhile, he's getting summonses for careless driving and leaving the scene. Plus, it's an old car, we don't have collision. Any suggestions as to how to proceed would be very appreciated.

He does not have to prove he wasn't driving, they have to prove he was driving. The fact that his car was wrapped around a pole is pretty compelling evidence. It is possible that someone could have stolen his car and done it, he did file a police report, right? If he didn't, this story is not going to work, please try again.

Besides your "family member," who's fingerprints were on the steering wheel? You had better hope it was someone else's prints - - otherwise your "family member" is going down for this one.

Exhaust all options. Did you go to the houses nearby to ask if anyone saw the driver that got out of the car? Next, does this person have CREDIBLE witnesses that can account for his whereabouts that evening?
As human nature goes, someone's "loose lips" may turn out to be just the proof you need. Word of mouth travels quickly. Good Luck.
