i was in an auto accident in 98. to make a long story short, my injuries resulted in a collapsed disc, stenosis, nerve impingement, all symtoms of degeneration. however at 37 should not have been so seviere. i have had fusion on the l45,l5s1 decompression and laminectomy at these area. i had no prior problem with these. no doctor appointments for back aches, and xray taken of spine in 93 showed everything in tact and no ddd. i am overweight, but this never caused the problem either as medical records show. the big problem 3 defence docs are saying pre-exisiting. while my surgeon says i had some ddd going on as we all do from the age of 20, he said the accident aggravated all symtoms. the defence doc says it chronologically with accident, not casual relationship to accident. HELP!!!!i am tired of being a yoyo. IKNOW IT IS FROM THE ACCIDENT, how do i prove it? i need case law or recent decisions to help fight this. i do not know how these defence docs can say these things legally. i live in canada and already have filed suit for the accident, but i would like to know how hard is it to fight this type of problem. i know friends have said if someone was in a wheelchair and got hit, they would still have injuries and just because they were in a chair means nothing. any help would be appreciated. thanks in advance as i feel my life is ruined by this. i have no social life and can not do activities of daily living....so i am just exsisting at the moment.

It sounds like you are representing yourself. Thus, you need to read and understand books that teach you how to represent yourself at trial. Nolo Press has such a book. You can find them at www.nolo.com.

Plus, you need to read up on civil procedure, evidence law, as well as proving medical damages at trial. Additionally, you need to learn how to do your own legal research. That will enable you to find and cite all relevant case and statutory law.

Or, you can hire a personal injury attorney that will probably take your case on a contingency basis. Good luck!
