car accident involving pedestrian

My husband was in a car accident in the Spring where he hit a pedestrian. He has reliable witnesses(total strangers to us) that say he was not driving recklessly, he was not speeding, he was not drinking/on drugs, and the pedestrian was not looking as she crossed the street. The woman was seriously injured and taken to the hospital.

We are waiting to hear from the insurance company, but I would like to know if we have any legal rights here? This was a true accident where he did everything he should, but just didn't see her - and she was jaywalking.

Should we be contacting our own lawyer or let the insurance company handle it? Is there any way it could come out to not be my husband's fault?

DO NOT under any cicumstances feel sory for the old bag that was hit.......feeling sorry will COST YOU a LOT OF MONEY!

YOU must understand something YOU are NOT at FAULT, but YOU will have to yell and scream and threaten YOUR insurance company NOT TO PAY HER!

You will have to call the the Insurance board, and maybe the president of the Insurance company to demand she NOT be Paid a dime.

YOU may have to be as nasty as possible and tell them ONE more step and i could have killed the bitccch, and I still demand my safe drivers discount Because am NOT AT FAULT!

You see if YOUR insurance company PAYS them a dime, YOUR insurance rates will go you WILL lose your safe drivers discount AND maybe YOUR insurance may be cancelled...read it its in your insurance contract

YOU must get YOUR insurance company to sign a release saying they are paying this out of their convienece, and it will NOT be charged against your insurance.

Thats when the yelling and threats will start ....becuse they will refuse and they will DEMAND you sign a settlement.

BUT you dont have to.....so be strong and learn you are going to get the shaft if you become a WUSSIE!

Since it was not MY accident, I am having trouble getting my husband to be tough with the insurance company. He feels guilty because she was an old lady and she was hospitalized.

As a spouse, I am trying to figure out how I can deal with this - the insurance company only wants to deal with my husband.

Oh well.. you'd better have plenty of extra money lyin around ......

Your husband is gonna open his mouth and it will cost you $$$$.

Its his choice....... to lose his safe drivers rates or maybe his insurance, and maybe have to pay HIGH risk rates, PLUS it can affect your credit as well...

Hmmm didnt know that?

Hubby is making a BAD financial decesion by feeling sorry for the old bag!
