My husband was in a car accident in the Spring where he hit a pedestrian. He has reliable witnesses(total strangers to us) that say he was not driving recklessly, he was not speeding, he was not drinking/on drugs, and the pedestrian was not looking as she crossed the street. The woman was seriously injured and taken to the hospital.
We are waiting to hear from the insurance company, but I would like to know if we have any legal rights here? This was a true accident where he did everything he should, but just didn't see her - and she was jaywalking.
Should we be contacting our own lawyer or let the insurance company handle it? Is there any way it could come out to not be my husband's fault?
