Hello,
I was hit by an oncoming car making a left turn at an intersection going south, I was going north. I was the first car in line at a stop light, my light turned green, and after seeing the intersection cleared, I went, she dartred out, and there was a collision. No injuries, just car damage.
No witnesses for either party, but after the accident, the girl says that she wasn't sure if she still had the light, or if she was at fault. She told me she had just moved to LA from Colorado, wasn't used to the traffic or knew the streets to well, and hesitated before deciding to "go for it". She also reported this to her insurance company. We decided at the accident scene that since it wasn't my fault, we would just go through her insurance company.
In my report to them, I stated she was at fault, she stated she was not sure who's fault it was, she did not know the streets to well, and that she did hesitate.
Now her insurance company says that they will not pay for my damages, because its her word against mine. Well her word wasn't against mine, and its clear that she had some confusion at the intersection. They want me to go through my insurance company, which means I pay a large deductible, and my rates go up.
My question is, based on the fact that in her report, she admitted confusion, but unsure of fault vs. me saying I am sure what happened, should I sue her (or can I sue her)?
Shes a nice girl, and I feel bad, but I think her insurance company is treating me wrong. What can I do about getting them to pay.
