What is the name of your state? Illinois

My friend's husband was in an accident last week in which it was not his fault. The woman was ticketed for failure to yield. Her husband had his license revoked on DUI so he was legally not supposed to be driving. My question is this: will the other insurance company still pay for the totaled van? And he is injured and incurred hospital expenses and time off of work - again with the illegal driving, does he have grounds to try and collect damages?

As far as him being able to collect on personal injury....he is entitled to be compensated for his pain and suffering. However he will be in major trouble for driving illegally.

Well my thoughts were that if he does try and sue or pursue the woman's insurance company they could deny payment because, theoretically, if he had not been driving since his license had been revoked, the accident would have never happened and they owe him nothing. Now that's just my non-legal, uneducated guess..... You would think since their insured is still at fault, no matter who she hit, he would still have a claim but again I'm guessing here.

Where could I find specific information on the laws, that are people-friendly? She (my friend) has no internet access and I don't think the presence of mind to even try to look it up....

And I know this looks like a situation where the "friend" is me, but it's really a friend lol :p . Luckily, my DH and I have excellent driving records and licenses!

Any help or direction is appreciated. Thanks!
