I just want to settle

I was in an acc last May. I've had 2 back surg in the past 20 years. The last one was in 1988. I was stiff and sore for around 3 months and have asked for compensation of a $amount per day thru Aug. It was the other persons fault. I have two letters from Management at my company attesting to my condition after the acc. I saw my doctor and he ackowledge that there was nothing major wrong, and I knew what to do for the pain. I didn't seek Physical Therapy because I know all the exercises and do them daily already. The insurer has offered me $600.00. They won't go further unless I produce medical affadavits of my condition for the months following.

My question, and sorry I wasn't specific, is: Do I have any rights for pain and suffering even if I wasn't under constant medical supervision to collect an amount per day for that pain and suffering? If I do, what is a reasonable amount for bruised and strained muscles of my back? I'm not after a large amount of money and do not want to spend more on a lawyer than I may be able to get from a settlement.... I don't have any lifelong problems from the accident.

My response:

Since you have no "medicals" to speak of, and while you are entitled to "general damages", it is difficult, at best, to assess due to the fact that medicals are nearly non-existent. Did you have an amount in mind? If so, what is that amount based upon, and why do you believe it is reasonable? You see, there is virtually no way for the insurance company to know what they are "buying" and why. To them, you were not injured, and went to the doctor just for the purpose of making sure. They do not know what you did at home to mitigate your pains because you were not under doctor's care; i.e., physical therapy. This really is a matter for Small Claims Court.
