car damaged while at hotel

I was at a hotel when some one drove though the parking lot and shot my back window out. It happened to about 8 cars around the parking lot. The cop that filed the report said he thought the hotel is responsable. I wasn't staying there, I was in the bar. The people who did it have not been found. Am I stuck with paying this? Would I win if it had to go to court? Should I go ahead and get it fixed then take the bill to the hotel, or should I just take the police report. I live in Indiana if that makes a difference. Thank you for any advice, it's going to cost quite a bit to have it fixed.

My response:

The cop is wrong. No one could have "foreseen" that some idiot would be shooting at cars in a hotel parking lot, and there is no way to protect against such an occurrance. Where is your "comprehensive" auto insurance policy in this equation? The deductible can be as low as zero, or up to the amount of your collision deductible. It just depends on how, or whether, your insurance ties them together in your policy.
Some people have "comprehensive deductible waiver." Call your insurance agent.
