car dealer lost cash for down payment

I gave my California dealer cash for a down payment, we signed contracts and I have been making my monthly payment for 4 months. He called me and wants me to give him another down payment, saying he never received it from me. I feel that once the $$ changed hands, it is not my problem. Do I need to give him more $$ or is it his problem?

This shouldn't be a problem, just show them your receipt for your cash paid!!

What, you didn't get a receipt!!! Why the hell not???

If you didn't get a receipt then it is just your word against their's. It may take a court to decide this one. Good thing you kept your bank records to show a cash withdrawal for the cash down payment, isn't it??? What, you don't have a bank statement??!! Now it is really just your word against his. Guess the judge will decide the most trusting witness. You vs. a car dealer, should be pretty simple.

Finally, we know that you have received the title to your car showing it is in your name, haven't you!!!!
