car dealer sold a ****ed up car!!!!!

What is the name of your state?ca

dealer sold me a used car on sat. with a leaking head gasket car was driving fine on the street until I got on the freeway took it to the cadillac dealer monday and found out the problem the cadillac service told me they had records that the last owner took the car there and they refuse to fix the problem so I guess he auction the car and the dealer bought it and sold it to me I'm wondering could I take the dealer to court for selling this car to me?

No. It's a done deal. The car, apparently, was sold without warranty. So, this is a case of "Caveat Emptor" (Let the buyer beware).

California: It is not a done deal!!!!!!! Look up a s*** load of California Civil Codes starting with "implied warranty"

What an idiot!! The issue of 'implied warranty' (assumed quality) could (and very slim even there) apply ONLY if the 'defect' were such that a normal inspection would not have found it. The buyer has a legal obligation to perform due diligence (ergo, caveat emptor) in inspecting the product BEFORE purchase. A reasonable mechanic would have found the leaky head gasket.... therefore, implied warranty is NOT an issue in this sale.

Before you give out more of your ignorance.... here is a definition for you:
caveat emptor
(kah-vee-ott emptor) Latin for "let the buyer beware." The basic premise that the buyer buys at his/her own risk and therefore should examine and test a product himself/herself for obvious defects and imperfections. Caveat emptor still applies even if the purchase is "as is" or when a defect is obvious upon reasonable inspection before purchase. Since implied warranties (assumed quality of goods) and consumer protections have come upon the legal landscape, the seller is held to a higher standard of disclosure than "buyer beware" and has responsibility for defects which could not be noted by casual inspection (particularly since modern devices cannot be tested except by use and many products are pre-packaged).

there was records that gasket been leaking!

There was records at the cadillac dealers service that the last owner had a leaking gasket and the owner refuse to fix the problem in 12/04 so I guess the owner sold the car in a auction saw it on carfax and the dealer bought it and sold it to me I wonder how the dealer pass smog with this problem do I still have a case with this imformation

Nope.... and your case (which you never had anyway) would be even weaker, as the 'leaking gasket' should have been noticeable by any competent mechanic that you should have hired to inspect the vehicle BEFORE your purchase.
