i live in florida
i was backing up my car when someone behind me was backing there truck up. they backed into me and then said they would pay. he admitted to me that it was their fault. now he said he will not pay. the damage is estimated at 350 dollars by the car dealership. my questions are:
-should i get it fixed now?
-should i take him to small claims court?

Send him a demand letter, notify HIS insurance company, and if he does not pay, small claims court would be my approach.

If you can get it fixed well for less than the delaer's shop estimated you may want to do it as you may not win and it may be hard to collect. See Small Claims on FreeAdvice.com

Thank you for your response. I did send a demand letter. Unfortunately I did not get his insurance company name because he repeatedly said the accident was his fault and he would pay (true statement). I will check another auto body repair shops for price comparisons. I went to the Dealer because the car is a '99 and I would like it to `look new' for at least one year!!
