Car deposit with receipt

About two months ago I had given someone who owns his own auto body shop 1250.00 as a deposit on a car. We looked at cars at his personal residence which were out of my price range but was informed he would be going to auction to find one that would be suitable. About one month ago I found out that I have to move out of state earlier than expected and I contacted him to retrieve the down payment as a means to move. Initially he had told me I would be able to get it back but the last couple of weeks he has not been answering my texts or calls. I have the receipt and said car dealer and myself currently reside in the state of Connecticut. I'm wondering what course of action I can take if any to retrieve my down payment. Thanks!
