I'm getting discouraged eventhough I've been told its early days yet when dealing with insurance companies (I was rearended 10 days ago). The insurance company of the boy who hit me offered me $2020 for my car. I had purchased the car for $4700 8 months ago so, of course, I refused that offer. The company sent me their 10 page ADTP readout of how they arrived at that cost. I turned to my own insurance company and they came back two days later with an offer of $2650. I turned that down, as well.

I had contacted an attorney regarding my personal injury claim so that I would not make any stupid mistakes (eventhough I had already given taped interviews to both insurance companies because I was under the assumption that nothing would be done unless I did). I do not think I in any way gave any indication that I accepted any fault at all and did not jeopardize my personal injury claim, either. (The other's insurance did say during the taped interview that they were assuming liability.) The attorney I saw said that he would not represent me for the property damage since I would probably be able to get just as much with or without his help owing to the settlement share that would go to him if he represented me. He did give me some advice along the lines of visiting dealer's to get prices for a replacement car, etc., which I did. All the information I collected agrees with Kelley Blue Book and Nada that a car like mine, same year, mileage and condition would retail for at least 3900. He also said as a last resort I may be able to do a civil suit under a statute for Oregon that allows for amounts under $5500 plus court/legal costs. He was going to get back to me Monday with the name of someone who might be able to help me with that.

Regarding my personal injury, he felt that my case would probably not need legal help at this point since it appears that my injuries are minor (less than 2 months to recover most likely). He said once my treatment appears to be 2 months or longer I may want to consider retaining him to represent me.

I'm posting because I'm feeling like I'm probably going to go through all this stuff and end up with what I would get now anyway. I'm discouraged because it all seems so unfair. Any advice or encouragement out there? Has anyone out there actually had an insurance company come up on their initial offer without legal action actually being taken?

I can tell from your words that you are desperate. Okay, you spoke to the wrong attorney - - that happens. The goal here is to get this matter out of your hands so that you can sleep at night. This is not something for you to handle on your own. Keep calling attorneys until you can find one that's HUNGRY enough to take your case, handle it, and complete it, so that all you have to do is see your doctor, and not be concerned with the rest.
