1. I volentarily gave up my car when my income unexpectedly dropped big. No late payments even.

Is there any limit to how long they can take to sell the car? its been 2 months, and they have not even attempted to sell it yet. Ive called and called, they basically say its not their problem, and they can take as long as they want. Dont they have to make a reasonable attempt to sell it? In 2 months, it has not even gone to auction yet.

If I file bankruptcy,can this debt be cleared even though they have not sold the car yet?

I could get a refinance loan to pay off the rest of my debt, but UC lending wont give me the loan until the car is sold.

Any Suggestions?

Yes, if you file for bankruptcy the loan will be discharged.

I don't know if there is anything that says they must try to sell the vehicle within a certain period of time, they may be right on that point.


I know this is a very late response, but if this matter hasn't been solved yet, I know that in most states you can demand that the car be auctioned. They can ASK you if they can keep it, but you can demand the auction.
