I sold a totalled car to an auto body repair shop owner (who I thought was reputable) back in 2004. Title was signed by me as the seller and exchanged for cash, all that was needed was for him to complete the buyer portion and turn in to the DMV (which he said he would take care of). Since then, I had found out recently that this guy decided not to transfer the car in his name but continued to hold on to the car for the past 3 years with no contact whatsoever. I received a call over the weekend from a 3rd party who I believe is trying to purchase the car from the guy I sold it to, but needs a copy of the title and is contacting me to help sign over power of attorney so they will be able to do it on their own (the guy I worked with 'lost' the original copy and I guess is not able to complete the transaction without it.
Since I sold the car in 2004, I have since had to pay 2005 property taxes (around $200) on the car since the title was not transferred as promised and the state was starting to pursue actions against me. I am also concerned with the state asking for back taxes for 2006 & 2007 (including interest) once they have it in their system that the title just now 'officially' changed hands. I insisted that the car be removed from my ownership back in 2005 and has not been in any records since.
What can be done to make sure that they guy I sold the car to will be liable for fees I incurred for the car after the sale present and future?
