I am in Texas - on 8/10/01 I was rearended while completely stopped and pushed into a vehicle in front of me. Eventually they decided the damage was too great and totalled the car. The day I told them I would settle and sign my car over to them they called the rental car place and terminated my lease. I have not received any papers to sign agreeing to the settlement and they are saying they have no obligation to send methe check in a timely manner. The insurance agency is Insurance Depot and the policy is under State & County Mutual. I am a single parent - and until I receive the check I cannot purchase another vehicle. This will put me out. Is this legal? Is there anything I can do to make them pay for the rental car until I receive the check? Once I sign the papers agrreing to a settlement on the car - can I go back and ask for medical claims?:confused:

I'm from PA and in the same situation fighting for a rental. I'm curious to find out what our rights are with obtaining a rental.... we shouldn't be put out because THEIR insured totaled our cars. They were the ones not paying attention not us, why should we be stranded? I wonder if we can go after loss wages for not being able to get to work. :) All in all, it was their fault and WE should not have to suffer!
