Car warranty co will not pay

To me this situation seems simple. The warranty Co is seeing what they can get away with. But please help me if there's something I'm not seeing:

My car radiator fan stops working, causing the a/c system to be abnormally loud and the car overheated. I get it home and let it sit for a couple days until I have time to get it to a mechanic. My warranty is through "Warranty Solutions". the term is 3 yrs/30k miles. It's been 1 yr and I've driven the car 4k miles. Clearly in the warranty contract the radiator fan, motor, etc is named as being covered. I've never had a claim with the warranty co until now.

I take the car to the mechanic. He says it definitely is the radiator fan motor assembly. He calls my warranty co for approval to cover the repair. Now this is where the story gets weird. The mechanic calls me after he did the diagnostic to find out what was wrong, and he tells me that he called the warranty co and they refused coverage. he says that he told them the fan assembly/motor failed and that they "asked him if the car was overheating, and he answered, no". So ... he told them wrong info. I guess he forgot I said the car overheated when I brought it in? At any rate, the part failed. What difference does it make if the mechanic said the car overheated or not?

In my response over the phone, I told the mechanic to go ahead with the repair and I'll work it out with the warranty co later.

Tomorrow i am going to call the warranty co and demand they cover the repair cost as per the terms of their own contract. If i get a negative response I will threaten [and follow through] with taking them to small claims court for the repair cost minus the deductible.

Is there something I'm missing here?

Sure, What is the name of your State ? ( US LAW ONLY ).

Read your contract .

Who puts in for a claim ?

By what method?

Talk to the mechanic again ,and if in fact the auto is overheating have it noted.

If refused file a complaint with your local ( U.S. ) Office Of Attorney General - Consumer Affairs .
