I purchased a mini van 3 years ago in Colorado. My transmission was just diagnosed as shot along with the drive train. They will have to be replaced at a cost of $4500. I had the car towed to the dealer. The dealer claims the reason the transmission was wrecked was because I put 2 tires on the van in April of 2004 and the tire size was different ( the circumference) front versus back tires. The mini van is an all wheel drive. I put 2 tires on the van because I noticed excessive wear on the front tires. The dealer did a test and there was a 3 inch difference when they rolled the tires 10 feet (front versus back). The tire dealer (not the car) has told me that he has never seen an issue with 2 tires that are the same size. The Car Dealer will not cover the $4500 cost to fix the transmission because of a clause in the warranty that states:
Damage caused as the result of any of the following is not covered:
alteration or modification to the vehicle including the body, chassis or components after final assembly by GM.


there is a bit more to this clause but nothing to note here.

They claim that replacing 2 tires voids the warranty because the new tires caused the damage.

Does anyone have any idea of anything I can do to get the dealer to pay for this repair which I believe should be covered by the warranty. It seems unreasonable for replacing 2 tires instead of 4 would result in a bad transmission. By the way the car dealer checked and the rating of the tires was the same p255 r14 (or something close to this!)

What make/model/year of vehicle?

What were the two tire sizes?

How many miles were on it when you had the tires installed and how many when the failure occurred?

It is a 2002 Chevy Venture
I don't have the size of the tires. The car is still in the shop.
The car dealer did look at the tire sizes and verified that were the same on the side of the tires.
The mileage was 27,508 when I put the 2 new tires on.
It has approx 33,600 miles when I had the transmission fail.

There was no indication of any problem until I tried to back the car out of the garage.

The bumper to bumper warranty expired the day after I had it brought to the shop, just a coincidence.

both front and back are 225 60 r 16
