car wreck, in Illinois

My 14 year old daughter went to a friends house, and while she was there this girl came over to visit with both girls, the
girl had never been to the house before, and
no one knew her that good, she asked to the
dad to borrow his car so they all could go
cruiseing around, she told the dad that she
had a drivers licens, and he told her ok..
well the girl got into an accident, and totalled the car, she was fined $750.00 for
driveing without a drivers licens, and now
the dad wants all girls in the car to pay for
the replacement of the car... can he legally do this, the girls had just recently met this girl and had no idea that she did not
have a licens, and they were just passengers.

My response:

There is no rational reason for your daughter to be held responsible for anything. He owned the vehicle, and only he could have given permission. It was legally incumbant on him to check that the girl was licensed. However, having a license or not does not, in and of itself, cause an accident. His beef is with the driver, only, for his damages. His problem will be in explaining to a court, absent an emergency, why he gave his vehicle to an unlicensed driver.
