In an unfamiliar area and did not see a stop sign. I had BAC of .08 . The man who hit me had a BAC of .163 . He also was not wearing a seatbelt and in one of the 2 accident reconstructions it was stated that because he was not wearing a seatbelt contributed to the severity of the accident by failing to utlilize the available seatbelt. He also had no reaction to the accident. I am now going to trial for the charge of careless driving resulting in death. The man was also speeding, I on the other hand was not.
