What happens to the property now?

What is the name of your state? West Virginia
My mother and father was separated for many years because he was bi polar. My sister had power of attorney over him. My mom lived in the house she and my father got before he became sick. Mom paid the house off in 98 and had it put into her name. She then died in Dec.98 with no will. The fiduary said that there was a lean put onto the houseof $3300. This was never paid. The taxes on the house was paid every year after her death, which was in my dad's name. He died October 2005 with no will as well. What happens to the house now?

Who put the lien and for what reason?
This was never paid.
Then it needs to be paid don't you think?

that depends entirely on the answer to the above questions.

A company named Commercail Credit put a lein on the house because mom still owed them money. Commercail Credit is no longer in business. I'm willing to pay this off.

I paid the taxes on the house after she died. The taxes had my dad's name on them so I thought that the house went back into his name.

Then you need to find them or their registered agent by contacting the Secretary of State's office. In lieu of that , you'll need an attorney.

You thought wrong. You now need probate.

Probate is needed to officially declare who the legal official heirs are. Heirs can then decide if they want to sell the house or not. It would be wise for you to get the lien paid off whenever you can, so that whether the home is sold or now in the future, the lien will be taken care of--otherwise, if it wasn't paid, the lien would be deducted from any profit you make on the sale of the home.
