OK, this is a first for me . . .
One of my houses has carpet that has 4 years of wear on it, but it was not ready for replacement yet (I usually get 5 or 6 years out of carpet - but I have good tenants). Upon walkthrough last night with my tenant, I see two holes (about 2" each) in the bedroom carpet (looks like a chemical burn). The fibers are all gone (melted?), down to the backing, which is still intact. Of course, she said it was like that when she moved in, but I say it wasn't. We documented and took photos of all prior damage, including a small stain about 5 feet from these holes when she moved in, but of course made no mention of the holes, (because they weren't there). It will be her word against mine if it comes to a court of law and she'd be hard pressed to explain why we documented a smaller stain, but skipped over two large holes.
The whole house (2 bedroom, hallway & living room) is done in the same carpet. The bedroom is about 20 yards of a 100 yard unit (measurer is coming on Monday) and I will go ahead and replace all of the carpet.
Question; how much of the replacement carpet can I legally charge her for?
Do I charge her 20% of all the new carpet (4 of 5 years are gone, so it's 80% used).
Or do I charge her 100% of just the damaged bedroom (which would be about 20% of the apartment)?
It comes out the same $$$ either way, but I want to make sure I word it correctly when I return her deposit, so if she does takes me to court, I've done what's legal.
I'm not trying to get any more than what I'm legally entitled to. I just need to be fair to myself.
