Hi all! Hope you can help!

I moved into an apartment in September 2009 - they had installed brand new berber carpets prior to me moving in. Some of the carpet began coming up, mainly at the seams where 2 pieces meet, but there were also a few random pulls in the carpet. I notified management about this and they did nothing. They had a maintenence guy come do a "pre moveout" inspection a few weeks ago - basically just seeing if anything is drastically wrong. He noted that there were some pulls in the carpet, but said they were no big deal.

Just did my actual move out inspection today with the manager and she's saying they now may have to replace the whole carpet. She kept saying things like "I know it's not your fault" and "I hate berber carpet, that's why I don't use it" etc etc. I indicated that the maintenence guy said they were just minor repairs to which she didn't really reply at all, but just kept going on about replacing the whole thing.

I asked her if she could just replace the damaged sections and she said that she ceased all installation of berber carpet and would not allow the carpet people to install berber whatsoever, even as maintenance. She said she would only allow plush carpet to be installed - because she knows there's an issue with berber pulling occassionally.

I know that the pulls obviously happened when I lived there, so I am liable for that. I was just wondering if I would be liable for them installing all new plush carpet rather than repairing the berber if it's possible?

Any thoughts/advice are appreciated!! Thanks for your help!!!

Did you DAMAGE the carpet or did the pulls occur in the course of normal use? Do you have a pet that was scratching the carpet? Were you dragging a lot of heavy furniture across it all the time? The pulls sound like normal wear and tear to me unless there's something you're not telling us.

No, I didn't do any actual damage to the carpet. Like I said, the seams started to come up by themselves and I think that was just an installation error. Only times I ever dragged furniture was during move-in and move-out, but the pulls occurred between those timeframes, not during the moving process. I do have 2 small dogs but they do not scratch anything and I had special foam flooring put down in the area where they were kept while I was not home so that nothing could happen to that carpet. In fact, one of the pulls was underneath where the flooring was - where no one could ever get to it. So without it ever being touched, it pulled.

Until you get something from the management saying if they are going to charge you for anything there is nothing you can do. You don't even know at this point if you will be charged anything.

Good point :) I'm just trying to be prepared. I think they're going to have the carpet guy at least look at it so he can determine what can be done.

Btw, she can't charge you to replace the whole carpet if only one piece or small area is messed up. She can only charge you for damage you did. The pulls could very possibly be attributed to your pets. whether you say you had something covering the area or not. The seams would not be your fault, from the way you described it it does seem like bad installation.

There was damage to 3 seam areas (you can clearly tell that they're seams) where it's just coming up. Other than that, I believe there's 2 additional pulls in 2 separate rooms. Even if they did replace the carpet just in those rooms, I think it's ridiculous to replace the carpet in the entire apartment just because she wants it to be plush and not berber.

I'm going to take some pictures tonight so I have them just in case. Anything else I should do to be prepared?

I got several quotes for the carpet the other day - all no more than $150. When one guy was coming out to check it out, management had sent maintenance to check it out also. They were pissed at me for getting all these estimates and then decided that they would fix the carpet rather than replace it. Only taking $100 out of my security deposit for the repairs. I won't get my deposit back for about a month, but I'm keeping all of the estimates just in case they try to charge me more.

You are not responsible for the seams comming apart .

Were the seam damages part of the estimate ?
