case dismissed because lawyer didnt respond.

i had a medical malpractice suit against several drs. to make the story short my lawyer failed to respond to something he thought he had. but the case was dismissed because of his failure to let them know we had an expert witness even though we had notified the opposing counsel in person the other lawter said we didnt tell her in writting in time even though he thought he had. the commisioner who over saw the hearing to throw out my expert witness said my laywer failed to tell the other lawyer we had an expert witness. and they even speak of him as our lawyer. is there something i can do about my lawyers mistake and negligence to get the dismissl overturned and to get my expert witness back in the case?? HELP PLEASE I HAVE 3 YEARS OF MY OWN EXPARTE INVOLVED, THIS IS A LONG STORY WHICH CANT BE MADE SHORT.

Has the statute of limitations expired? If so, you probably have no other recourse, and therefore, no possiblity of re-opening your claim.

I would suggest you contact your states bar association and inquire whether your attorney has a history of this type of negligence. I would then file a formal complaint against him/her.

Your attorney has been negligent, and as a result, you have suffered damages, i.e., you cannot recover your losses through your malpractice litigation, as it has been dismissed. You have an excellent claim of legal malpractice.
