My former landlord was trying to sue me for alleged damages. We had to go to small claims court yesterday (3/12). My former landlord never showed up so the judge dismissed the case. Now, can my former landlord still try to sue me or is it over since the judge dismissed the case?

My response:

That depends upon the type of dismissal; e.g., with, or without, prejudice. My suspicion is that the judge dismissed "with" prejudice, and that means the landlord cannot sue you again over the issues he sued you for. However, if you cause the same damages again at another time, the landlord can sue you for those new damages, even though they are the same or similar to the damages that were dismissed.

Then, you better hope that the judge dismissed the case "with prejudice." You can call the court clerk to ask what type of dismissal it was.
