Case of libel? or just bad luck?

There was a criminal indictement on Dec 15, I was not indicted (two others were), but I am named as a defendant in the civil suit. Most publications list me as an associate/friend, and the few that print my name clearly state that I was not criminally charged. One magazine however lists my name along with the other two and ends the sentence saying that all three of us have fallen to the status of accused criminals. Is this libel?

My response:

Send a certified return receipt letter to the publication editor and the reporter asking them to voluntarily retract and correct their story, for the reasons stated in your post. Further, request that they send you a letter confirming that they will do so in the same size, placement, & type in their next publication. That, finally, if they fail to do so, you will consider legal action and seek damages.
