I am from Texas and was wandering if I have a case. In my husband's divorce decree, it states that each party is responsible for the co-payments, any and all bills associated with the treatment received, and any deductibles when the children are in the care of either parent (each parent pays the cost when they take the children). We have provided statement upon statement to her. Well, his ex has not paid any dental bills which have now accumulated close to $500. She also has not paid the deductibles.

Also, in the decree it states that we are not to pay child support for the month of July which they are with us. However, last year, the children when to Saudia Arabia with his parents for the summer and she wrote in a letter that she would refund the June payment to us since neither of them had custody during that month. Both signed and dated the paper. After they returned, she refused to give the money back.

Lastly, there was an overpayment of child support in the amount of $514. The child support registry is trying to tell me they can do nothing about it that I will have to wait until the children graduate high school before I can petition to get this money back. I have the divorce decree stating that he is not behind in the support and it is dated years before the letter stating that he was behind.

My question is, can I take all three of these things to a small claims court and have a case? We have asked numerous times and she refuses to refund anything or pay the dental bill.
