Cat Attacks Dog!!

My friend was taking care of her bosses small dog. I invited her to come over to my apartment to visit, knowing she had the dog with her, and she knew that I had a cat. She came over with the dog on a leash. When she entered the apartment she let the dog of its leash and the dog started running around the apartment. The cat was asleep on the bed and the dog went up to the cat and started messing with it, in turn the cat turned around and attacked the small dog. The dog sustained a laceration to the leg which required veterinary assistance. We took the dog to the vet and the bill was $219.00, which I paid for with the understanding that my friend and I would split the bill in half when she had the money. Now she is claiming that she wont pay because it wasnt her dog. What recourse do I have to collect half of the money or better yet all of it at this point? Am I liable if she allowed the dog of the leash in my apartment?

You can try and sue her, but I wouldn't be surprised if a judge views it from the perspective that it's your house, and your cat that did the damage. You could have easily not allowed the dog to enter, or taken steps to ensure they stayed apart.

You could also try and argue that the dog sitter was negligent in letting the mutt loose...especially if you instructed her not to (did you?). Probably won't fly though.

If you can prove you had a verbal agreement to split the costs, you could go that route in court.

Wouldn't be surprised if a judge found that to be a reasonable thing to believe...it seems to be the most "moral" solution.

In any event, you have to decide if it's worth the trouble of filing for a 100 bucks. You are probably best off learning a relatively inexpensive lesson...and at least now know what kind of "good" friend you have.

Yeah I could prove we did have a verbal agreement which I thought was only fair. But it isnt worth the trouble for $100.00.

The better lesson is the one learned through finding out who your friends really are.
