What is the name of your state? New Jersey
I sent a Ronald G. Opher licensed debt collection attorney in Pennsylvania and NJ a cease and desist letter sent certified on July 15 2004.

He has now filed a civil suit against me?

Can he legally do that without violating the FDCPA?

Filing a lawsuit is not an FDCPA violation.
Unless the debt is SOL, a C&D letter will usually trigger a lawsuit since this is the only way they can contact you.
