cell phone contract

What is the name of your state? NY

I signed up with a cell phone carrier where I had to make a deposit for the service. In the contract it states that after 12 months of consecutive service the deposit will be refunded to you in the form of a check or credit to your account. I have now been with this carrier for 19 months, and when I requested a credit to the account for the deposit, they claimed they had the right to change the contract at any time, and since I have not made 12 consecutive, on time payments, my request was denied. If they were going to make that change to their contract, should I have been notified of the change? Is their actions legal?What is the name of your state?

Did your original contract indicate you had to make 12 consecutive on time payments & did you? Per your post it seems as if you didn't. Many phone carriers require this before a refund of your initial deposit.

The company was with Nextel, and as far as I can see on my contract, it only says after you have had 12 consecutive months of service.

Because you made some payments late was your service ever disrupted?
