I want some feedback as to what happened to me today.
Here goes.. I have been driving to a nearby park everyday this week. All I've been doing is sitting in my car, listening to my radio and having lunch. Well, today a policeman pulled up behind me and ask me for my licence. At the time all I had was a 30 day permit with a 5 mile radius from my home. He went to his car, did something, came back and had a ticket written out for me. He said I have violated terms of my permit since it is more than 5 miles from my home, but he said this in a manner that told me he was guessing and had no proof. And he did not prove to me how he knew this. He said the office recieved complaint calls because I've been at this park all week stay for an hour to eat and relax for the most part then leave.
Well, I disputed with the officer that I was within my 5 mile radius. After the officer handed me the ticket I decided to set my odometer and see just exactly how far it was to my home from this park. It was 5.6 miles. I think I'm going to try and fight this though, because later this day I was issued my temporary licence with no boundary limits. Do I have a good defense to advise the judge that the officer did not share to me the criteria he used to determine I was outside my limit? Seems to me if a person is issued a speeding ticket the officer needs to advise the driver how much him/her was over limit.
