I am a male who filed for simple no fault divorce in Florida 3 years ago. Separated immediately. Spouse originally agreed to a settlement, accepted lump sum payment and monthly payments. Reneged. Counter filed petition. I need to know if it is possible for me to counter this with a FAULT divorce due to mental and emotional cruelty on behalf of my children and myself.

My response:

Fault divorces, on average, cost far, far more to litigate than no fault divorces. If the "principle" is more important to you than the money it will cost you, then you need to file the appropriate Motion with the court asking for an order to change the grounds from one to the other.
