My husband's son 13 and he wants to live with his father now. His father, my husband, recently received disability benefits. He has filed for custody, with an attorney, and the child has spoken with the magistrate stating that he wants to live with his father. The mother is taking her time signing papers and supposedly signed a rough draft the first of this week.
There is a considerable amount of back disability payments that the child is to receive. Can the mother get this disability money in the middle of a child custody case, knowing the father is going to get custody of the child? If she can, can she keep it when the case is complete?

when dealing with your children and their best intrest it is always best to have an attorney. Tell you husband to call the legal aid office in your state and see if they would be able to help. Its not illegal to represtent yourself in custody or anything else but it is not a very wise choice to say the least.

If she's agreeable, it should be possible to file for a modification in custody and support on their own.
