I have raised my grandchild for 14 years,his dad is military,mother took him on days off.Now he wants to live with his dad,which we feel is best for him.Mother is abusive verbably & emotionally.All she wants is child support which she has been getting & keeping all the time I had him.He is going to be 15 in March and does not want to live with her. When he told her this summer he wanted to live with his father she took him away from us and now he has to live with her.Can he decide who he lives with?We are in his father's corner in spite of fact she is our daughter.Her older son,24,also went to live with his dad until the man died and came back to me.She took him in order to get his checks.He could not stand it and went to live with an uncle and she kept his checks and never gave money to the boy.Does he have any chance at all of a custody change.She tells him when he is 18 she will put him out with the garbage.She will not allow us too see him as she knows we agree he should live with his father.He has spent summers with him for years now and he keeps in close contact with him always.Please help.BJ

The father has a very good chance at custody. Have him retain an attorney and file asap! In fact, with the details, I think he could get an Ex-Parte motion through giving him Emergency temp custody.

Who holds legal custody of the child? -- it sounds from your post as though the mother does so I will go on that for now......
Any action regarding custody needs to come from the father of this boy - he will need to petition the courts where the boy is at for custody of his son. Being that he is 14, it is highly likely that the boy's opinion will be considered by the court in deciding the matter. Your support of the father is wonderful, however the most you can hope to do is to be involved as character witnesses if needed as the only persons with the right to file any sort of petitions here are the child's biological parents.
The best advice you can be given would be to get behind the father in his attempts to clear this up -- get him to file the petition NOW.
