In Sept. 2000, I retained a lawyer to represent me in my divorce. I immediately paid the retainer fee and provided financial & other information, as requested.
Since then, I have been waiting to move ahead with my divorce...the few meetings which he has accorded have been discussions on an agreement prepared by my husband's lawyer (inappropriate for my situation). He has not provided any such documents on my behalf or representing me in this divorce. He has filed some papers on my request: legal separation; a change of name (seeing how slowly we were progressing), and finally for a court date...still pending. The final week of November this year, I have called his office 3 times and wrote 2 separate letters requesting his response.
I feel I'm a victim of my own patience and time/money have been squandered over documents that do not represent me, never mind the aggravation of unreturned calls. It has been 16 months since I first retained his service to represent me; I have paid all bills prompty; I still am not divorced.
I need to move ahead, and assume we will be awarded a court date early next year. I wish to have appropriate representation in time. What do I need to do to officially disengage from this lawyer? Is there any claim to recover some of cost, in light of his not rendering services?
