What is the name of your state?The non-custodial parent (ex-wife) lives in Fl. The custodial parent (ex-husband lives in West Virginia.
They were divorced here in Fl and he finished the divorce and then moved to West Virginia to take care of his sick mom with the kids. He is disabled and receives disability checks each month.
Now the ex wife did not want the kids and she was and still is a drunk but working most of the time. In the divorce papers it clearly states that the wife is suppose to keep in full force medical and dental on the kids. Well she lost her job and the kids do not have any insurance.
The husband wants to take her to court to get her to put medical insurance on the kids but he says that West Virginia will not let him do a change of venue.
He has lived up there for the last 3 years and wants to transfer the case and the state will not let him.
What gives?
What can he do in order to get the case tranfered and what papers need to be given to the courthouses to get the case where it needs to be.
He needs it to be in West Virginia, he can't leave his mom alone. (he is the last surviving family member)
