My husband filed Chapter 7 for credit card debt and had his 341 mtg. in March. Since then, the trustee and lawyer have written letters back and forth with no resolution to date. My husband is in a situation now where his truck needs repairs -- 12 year old truck/160,000 miles. It has broken down 3 times this year while commuting to and from work -- a commute of 60 miles round trip. The only "disposable money" he has is the $100 per month he puts in his 401K because the company will match it. His lawyer told him not to touch it. Of course, the trustee is pushing for a Chapter 13. It probably will not pass inspection in November without the repairs. What he really needs is to get a "new" used car, but that's out of the question for now.

Questions: 1. If forced into Chapter 13, can he amend Schedule J to include the necessary repairs he has to have on the truck? 2. Expenses have increased since he first filled out the forms back in December, 2003. Gas is now $1.95 in our area and our school taxes this fall are going up 9%. The dentist has told him he desperately needs a root canal. Can these be added too? These would be well over the $100/month he puts in his 401K.
