what can i do about the neighbor behind me who does not like children and he complains about everything done. the new manager is his friend and she made changes to the lease to suite him. he sits outside and drinks and have all the festivities he wants but everyone else must do what he says or he reports you and she amends the lease very unprofessionally:

It is Illegal for a landlord OR tenant to make changes in a lease,

unless it is in writing signed by both of you.

The landlords only remedy is to make the changes in the new lease Or NOT renew it.

does your city /county have a renters advocate office or pamphlets available to all renters from clerk of the court ? call on phone and start asking

i will contact the city about my questions on tomorrow. i also request a copy of my files since i have been living in the complex to see what other complaints. i have been waiting on them to forward my information for two weeks and there isn't anything to send. the manager expressed the reason for the changes to my other neighbors.

Its still the same answer, YOU signed a lease and YOU expect the landlord to honor it as well.

Their only 2 options are: NOT to renew your lease.

OR to add the changes in the new lease.

PS they cant refuse your rent either, and Make sure YOU dont pay it late, or in cash..... why make things worse on yourself.

Mgt should not give you "copies of your file" and lease change that was not agreed to by you is "unenforcable". Difference is that original lease stands, just anything that the manager has inserted afterwards has no effect in law.

Since you don't say what complaining "neighbor" is complaining about, if it is your kids' yelling, playing, then you should address that with neighbor AND manager.

There is already case law where apt residents have complained about excessive kid noise and it has been ruled NOT to be discirmination because individual tenant/parents were advised to find alternative play venues for their children - take them to a park, find indoor activities. Just because you have kids, does not mean that neighbors have to live with screaming, yelling outside THEIR apt.
