My husband's custody agreement was finalized in GA. Due to several circumstances his ex-wife was awarded a very hefty monthly support ($2500 after taxes), as well as all college costs ($400 a month) and health care paid by my husband. With my husband's salary much lower - due to the technology bust - we would like to consider the option of lowering the payments. We also have the option of moving the case to TX, where the ex-wife now resides.

My questions are -
Is salary change a reasonable cause to change child support?
Is TX more ammendable to the father's case?
I have seen many formulas for calculating support - is there a simple formula or percentage?

Thank you so much for any help!

No, Texas is not very father friendly...they are very much in favor of the mother. However, they are usually agreeable to changing child support if the situation calls for it and yours certainly does since the original order called for such a steep amount.

In Texas the percentage runs like this:
25% of GROSS income for one child;
30% for two; and
35% for 3 or more.

Usually, the parent who does not have custody pays the medical insurance payments unless both agree otherwise.

Hope this helps...good luck!

Another suggestion if you change the venue to Texas...your husband should contact Father's for Equal Rights in Dallas, TX. They are a group of attorneys whose soul purpose is to help fathers get a fair deal.

Again, good luck!

Along with darkvictory's percentages, if you have any children or special circumstances, very special they do take that into consideration. The percentages must have gotten higher though when my husband got his divorce there it was 25% for 2 and 20% for 1. Good Luck
