changing last name rights?

My friends daughters mom wants to change his daughters name to the moms new husbands last name.My friend shares custody with the little girls mom.My question is does the mom need his signature to change her last name??How can he prevent her from changing it?please & thank you !

That is not going to happen unless he agrees. The court won't allow it.
California sets it up so if a parent files the petition to change their child_s name, the parent who files the petition must have the absent parent served notice at least 30 days before the hearing.

If the absent parent lives in California, s/he must be served personally with a copy of the Petition and Order to Show Cause.

So unless he agrees, no worries.

wait we live in california.Wait.....my friend just told me that his little girls mom has full custody but he faithfull pays child support & gets his daughter half the time.Theres never been a problem seeing her.He is a good dad & the relationship between him & his kids mom is good.

It's his daughter, right? The name cannot be changed without his consent. Whether he's the worlds best or worst dad..doesn't matter, if he objects, it won't happen.

Ok you can stop now. No matter what questions you ask or how you ask it the answer is going to stay the same. As long as dad objects it is not going to happen no matter what anyone tells you.

Listen...you will NOT be able to change the last name without the other parent consenting. If he says "no", then it does not change no matter how hard you try or what kind of motions you file blah blah blah.

PERIOD!

Now stop trying to find a way to get around that.
