What is the name of your state (only U.S. law)? Florida

WE live in Miami Dade County Florida. My son was born in 2008 and his father and I never got morried. His father signed the birth certificate and my son has his last name. Now I am not longer with him and I want to change his last name to my. or at least add it to his name as a last name. what do I need to say to the court. His father agrees and he will sign all papers. will the judge object if I want to change his last name top mine just based on this explanation?

thanks!

You shouldn't have any problems as long as both want the name change and you file both forms 12.982(c) and 12.982(d).
