My ex-husband and I were divorced in DE 3 years ago. We had a separation agreement, he has not done any of the things he agreed to. The major issue was the marital home that he agreed to take my name off within a year of our divorce. In February we were back in court as a result of a rule to show cause that I filed. At that time the judge ruled that he had 90 days to take my name off or put the house up for sale. If he does not comply with the court order, can I try to get the house?

My response:

Sure.

The court has already found him in "Contempt of Court" once, and will, the next time you bring him into court, allow you to take over the house. Also, the court will probably put him in jail for about 10 days or so because of his continued contempt for the court's orders.

Go get him !
