I have a couple of questions first info
I filed chapter 13 in October 2000 with about 20K in debt. Lat last payment is scheduled for Oct 2005. My significant other filed chapter 7 at the same time. I do not want to contact my trustee as I do not want to make waves, and our attorney was definitely not on our side (she used the laws against us as a gay couple, and I will never do business with her again.) We did not put our home in either bankruptcy (We are both on the mortgage as joint tenants with right of survivorship) Due to medical bills we cannot catch up on, we are reconsidering refinancing our home to clear up the debt (about $5500.00)

1) I was told that if I did this that I would be responsible for the entire amount that went into the chapter 13, not just the $1000 (approx) that is left Is that true?
2) Assuming it is, my are looking at having my partner apply for the mortgage just in her name. Would that effect my chapter 13 – what happens when suddenly I don’t have the mortgage in my name anymore, because it was paid off?
3) Should we consider doing either of these, or do we need to wait until my chapter 13 is done? Is there another option?

I'm willing to report it to the trustee but I want to know if it either scenario will cause my ch 13 to be dismissed, and I will have to pay the full $20 K, or if it can continue as is, even with the change..
