I filed Chapter 13 bankruptcy in 2004. The only thing in the bankruptcy are my mortgage arrearages. I make a monthly payment to the bankruptcy court, as well as my regular monthly payment to the mortgage company.

I recently tried to refinance, but was unable to due to the payment history being reported to the credit bureaus. Apparently, payments I make are being applied to the arrearages in the bankruptcy. For example, when I made February, 2006 payment, it was applied to the November, 2004 payment due (in the bk). Because of this, my credit report shows that I am over 180 days late on all payments up to the present.

Can they do that? I have made timely payments since resuming my regular payments, but that is not reflected anywhere. I asked them to correct this, but they will not.

Any help regarding this would be greatly appreciated.
