I am seriously contemplating filing Chapter 7 Bankruptcy as my personal credit card debt has gotten too high due to many unexpected personal circumstances. I live in Massachusetts.
My delemma is this: I have two bodily injury claims pending for two accidents (10/21/97 and 3/8/98). In both instances I was rear-ended and both were completely not my fault and a pre-existing disc injury in my neck was permanently aggravated. I am sure I will get a settlement either before or after litigation. If I file for bankruptcy while these claims are pending how will this affect my bankruptcy petition and any bodily injury award I recieve? My debt is more than two times what I think I might get from the insurance companies. Obviously I desperately need the settlement monies for my own expenses right now. I also have a young child and I would like to put some money in a trust account for her when I recieve it. Would I be allowed to do this?
I do not have a lawyer at this time but my three year statute is running on 10/21/00 so I might need one to file a complaint in court if the insurance company (#1) won't settle very soon. This insurance company is being VERY difficult. They refused my request to arbitrate, also.
Also, do they have access to my credit file and if so could the fact that I have high debt affect the way they are handling the settlement negotiations with me in offering such a small amount($3,000 and my medical bills for the accident on 10/21/97 are almost double that)?

Why don't you have a lawyer for a personal injury problem? Do you not have lawyers who work on contingency? I did far better with a lawyer than I ever would have on my own. $130,000 settlement which I retained after all expenses and attorney's fees about $90,000. Girl you need to get a lawyer, you're just being jerked around until your time runs out to file a complaint or suit. The insurance company knows what the legal limits are and they are going to continue to jerk you around until 10-22-00 and then give you nothing or close to it. Get a lawyer now, before it's too late.
